What the law says about insurance and vehicle use

The insurance baseline. Section 146 of the Motor Vehicles Act states the general requirement for a policy complying with that chapter when a motor vehicle is used in a public place, subject to the exceptions and qualifications written into the section. That establishes a statutory baseline, not whether a particular claim is covered. The policy schedule, wording, exclusions, described use and crash facts still have to be examined.

The vehicle-use question. Policies are written around a described vehicle and a described use. Whether a journey was a private trip or the carriage of a passenger for hire is a fact, and it is the same fact the permit rules turn on. The Motor Vehicles Act defines transport vehicle in section 2, and section 66 generally requires a permit when a vehicle is used as a transport vehicle in a public place, subject to that section's exceptions. The Tamil Nadu Transport Commissionerate's permit FAQ states the state's public position that commercial passenger or goods operation needs the relevant permit.

None of that settles a claim. Whether an insurer treats a journey as inside or outside a policy is its decision on the wording and the facts, and a dispute is resolved through the claims process and the relevant tribunal or court, not by a plate colour or a screenshot. The Act also provides a contract-carriage application and decision route in sections 73, 74, and 80. MoRTH's 22 January 2024 advisory advises States and Union Territories to accept and process motorcycle applications. That route does not guarantee a permit or decide the insurance consequences of any particular journey.

The aggregator layer. In the Centre's Motor Vehicle Aggregator Guidelines, 2025, clause 12 requires an aggregator to ensure onboarded vehicles hold the appropriate permit under the Act, while clause 23 says a state may allow aggregation of non-transport motorcycles for passenger journeys. A 2026 Parliament answer confirms that enabling reading, and section 93 keeps aggregator licensing with the state. The guideline addresses insurance among aggregator obligations too, but we quote no clause number for it: our check verified clauses 12 and 23 only.

Does Rapido cover a bike accident in Chennai? What we did not verify

A platform benefit, if one exists, comes from that platform's own current terms plus the insurance contract behind them. Those documents decide who is covered (rider, passenger, third party), for what, up to what limits, with what exclusions, on what deadline, and through what procedure. Every field can change, so last year's version is not necessarily the one that applied to your trip. Read the current terms yourself, save a dated copy, ask in writing whether that trip is covered, under which policy and with which insurer, and keep the reply. What the Tamil Nadu government told the court

On 3 August 2026, Tamil-language outlets Tamil OneIndia and Maalaimalar reported that the state government told the Madurai Bench of the Madras High Court that bike taxis were not permitted until a policy decision was taken, and that violations could attract penalties. That is what those reports say was submitted; we have not read the order and are not treating a news report as one. The New Indian Express reported on 15 July 2026 that the court had earlier asked the state for its stand.

Why it matters here: a permit or vehicle-use allegation can run alongside a claim as a separate proceeding. Section 192A addresses driving, causing or allowing a vehicle to be used contrary to section 66(1) or specified permit conditions. Section 207 authorises seizure and detention of a vehicle in listed circumstances, permits seizure of the registration certificate instead in some cases, and provides a document-based release application. A figure circulating online is not the automatic outcome of a stop: the alleged provision, procedure, any compounding, other violations and facts matter.
