Terms of Service

1. Agreement

These Terms of Service ("Terms") are a contract between you and Hustl. By creating an account, accessing our website, PWA, or future mobile apps, you agree to these Terms, our Privacy Policy, and other policies linked at hustl.today/legal.

If you do not agree, do not use Hustl. We may update these Terms; material changes will be notified in-app or by email. Continued use after the effective date means acceptance.

2. Eligibility

  • You must be at least 18 years old.
  • You must be a resident of India and use the service only for work in India.
  • Hustlers must complete identity verification (Aadhaar eKYC and PAN as applicable).
  • Partners must register a legitimate business and complete business verification where required.
  • One account per natural person or authorised business representative; no shared credentials.
  • You must not be suspended or banned from Hustl.

3. Platform role

Hustl is a technology marketplace and intermediary. We connect Hustlers with Partners posting short-term work ("Shifts" or "Jobs"). Hustl is not an employer, staffing agency, labour contractor, or guarantor of wages beyond facilitating payments according to these Terms.

Hustl does not control how Hustlers perform work except for job-specific requirements posted by the Partner (time, location, dress code, tasks). Partners are responsible for workplace safety compliance at their premises.

4. Independent contractor status (Hustlers)

Hustlers are independent contractors, not employees of Hustl or any Partner. Nothing in these Terms creates an employment, partnership, or agency relationship.

  • You may accept or reject jobs without penalty (subject to cancellation rules below).
  • You are responsible for your own taxes, insurance, and statutory filings unless law requires otherwise.
  • You are not entitled to employee benefits from Hustl or Partners.
  • You may work on other platforms unless you agree otherwise with a specific Partner.

5. Account and authentication

  • Registration requires a valid Indian mobile number and OTP verification.
  • You must provide accurate information and keep your profile updated.
  • You are responsible for all activity on your account.
  • Impersonation, fake identities, or duplicate accounts are prohibited and may be reported to authorities.

6. Partner obligations

  • Post accurate job descriptions, pay rates, timing, location, and requirements.
  • Fund jobs through the platform before or as required for publication.
  • Provide a safe working environment compliant with applicable Indian labour and safety laws.
  • Do not request illegal tasks or discriminate on protected grounds.
  • Respond to disputes and support requests in good faith.

7. Hustler obligations

  • Arrive on time, check in honestly using GPS and QR where required, and complete agreed tasks.
  • Follow reasonable dress code and conduct rules posted by the Partner.
  • Do not use GPS spoofing, proxy check-ins, or false location data.
  • Treat Partners, customers, and other Hustlers with respect; zero tolerance for harassment or violence.
  • Do not consume alcohol or illegal substances while on active shifts where safety is affected.

8. Payments, fees, and tax

Platform fees, hold periods, and payout timing are shown in-app and may vary by city or campaign. Partners pay for jobs through Razorpay or approved methods. Hustlers receive earnings in an in-app wallet, subject to verification and risk checks.

  • TDS: Hustl may deduct tax at source as required (e.g. Section 194C at 1% for individual contractors; higher rates if PAN not furnished per Section 194J).
  • Dummy / test credits: In staging or promotional modes, credits marked as dummy cannot be withdrawn as real money.
  • Payouts: Processed via Cashfree or approved payout partners to your verified UPI or bank account.
  • Invoices: Partners may receive GST invoices for platform fees where applicable.

9. Cancellations, no-shows, and strikes

  • Cancelling within 3 hours of shift start may incur a late cancellation fee debited from your wallet per platform rules.
  • Failure to check in without valid cancellation may be recorded as a no-show with a penalty.
  • Repeated violations may result in strikes, reduced job access, or suspension.
  • Partners cancelling funded jobs are subject to refund rules in our Refund Policy.

10. Disputes between users

Disputes may be raised in-app. Hustl may use GPS logs, check-in/out photos, chat records, timestamps, and QR verification to make determinations. Our decision for platform purposes (payments, strikes, access) is binding unless overridden by a court or regulator.

11. User content and intellectual property

You retain ownership of content you upload (photos, reviews, messages, listings). You grant Hustl a non-exclusive, royalty-free licence to host, display, and process that content to operate the service. See Intellectual Property and Takedown Policy.

Hustl branding, software, and design are owned by Hustl. You may not copy or misuse our trademarks.

12. Prohibited conduct

You must not:

  • Violate any Indian law or third-party rights
  • Upload malware, scrape data, or reverse engineer the platform
  • Circumvent payments or fees
  • Harass, threaten, or discriminate
  • Share accounts or sell access to accounts
  • Upload copyrighted material without rights

13. Suspension and termination

We may suspend or terminate accounts for violations, fraud, safety risks, or legal requirements. You may close your account by contacting support. Some data may be retained as described in the Privacy Policy.

14. Future subscription services (Partners)

We may offer paid subscription plans for Partners (e.g. featured listings, analytics). When launched, subscriptions will disclose price, billing cycle, auto-renewal, cancellation, and refund terms per the Consumer Protection (E-Commerce) Rules, 2020 before purchase.

15. Disclaimers and limitation of liability

The platform is provided "as is" to the maximum extent permitted by law. Hustl does not guarantee uninterrupted service, specific earnings, or Partner conduct. To the extent permitted by law, Hustl's liability is limited to the greater of (a) fees paid to Hustl in the 3 months before the claim, or (b) INR 5,000, except where liability cannot be limited by law.

16. Indemnity

You agree to indemnify Hustl against claims arising from your breach of these Terms, your job performance, your uploaded content, or your violation of law, except where caused by Hustl's gross negligence or wilful misconduct.

17. Grievance officer (IT Rules)

For grievances under the Information Technology Act, 2000 and Intermediary Guidelines, contact: grievance@hustl.today. We acknowledge complaints within 24 hours and aim to resolve within 15 days.

18. Governing law

These Terms are governed by the laws of India. Courts in Chennai, Tamil Nadu have exclusive jurisdiction, subject to mandatory consumer forum rights where applicable.

19. Physical work disclosure (Partners)

Partners must accurately disclose physical requirements when posting shifts, including heavy lifting (with approximate weight), prolonged standing, outdoor exposure, and other material hazards. Failure to disclose known hazards may void insurance coverage and result in liability to Hustl and Hustlers for resulting injury claims.

20. Hustler acknowledgement before booking

By booking a shift, Hustlers confirm they have read disclosed physical requirements and are fit to perform the work. Hustlers must not book shifts they cannot safely perform. False injury or insurance claims are fraud and may be reported to authorities.

21. Insurance and claims

Hustl may offer or facilitate group personal accident coverage in the future. Until active coverage is confirmed in-app, Hustl does not guarantee insurance for any shift. Any claim must be supported by truthful evidence. Partners and Hustlers agree not to collude on fraudulent claims. Hustl may suspend accounts and withhold payouts pending investigation.

22. Severability and entire agreement

If any provision is unenforceable, the remainder stays in effect. These Terms, with incorporated policies, are the entire agreement regarding the platform.
